Did the DEA go to far?

Sondra Arquiett was busted for possession of cocaine.  She pled guilty and received probation.  She later discovered that the DEA opened a Facebook account in her name and was impersonating her online.  The DEA went so far as to post personal and revealing photos of her. A prosecutor claims that she agreed to this when she consented to give the DEA access to her cell phone.  The DEA even claims that Arquiett “does not have a First Amendment Right to Privacy in the photographs contained on her cell phone“. Facebook has terminated the fake account and is demanding that the DEA stop the practice of impersonating Facebook users. Is this identity theft? Has the DEA gone to far?
